These Terms of Service ("Terms") govern your access to and use of brainticker.com and its services (collectively, the "Product"), operated by BrainTicker. By accessing or using the Product, you agree to be bound by these Terms. If you do not agree, do not use the Product.

1. Description of Service

BrainTicker provides a trader psychology diagnostic — a ~10-minute simulation that identifies behavioral patterns under market pressure across six dimensions (risk discipline, panic response, FOMO, revenge, trap recognition, plan integrity) and prescribes rules to address the most costly patterns. The Product includes:

• Free trading simulation sessions with archetype results and starter rules
• Paid AI Mind Analysis reports (5 sections: archetype deep-dive, deep-dive on why, 5–8 personalised behavioral rules, 3 process adjustments, 30-day action plan)
• User accounts with session history and activity dashboard
• Shareable result cards

2. Eligibility

You must be at least 18 years old to use the Product. By using the Product, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. User Accounts

3.1. Registration

You may create an account by providing your email address. We use passwordless authentication (one-time 6-digit codes sent to your email) to verify your identity. You are responsible for maintaining the security of your account.

3.2. Accuracy

You agree to provide accurate, current, and complete information when using the Product. Providing false information may result in termination of your account.

3.3. Account Security

You are responsible for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized access.

4. Free Services

The trader psychology test is available free of charge. Free services include:

• Taking the 10-minute trading simulation
• Receiving your trader archetype and 3 starter rules
• Behavioral callouts on your specific decisions
• Sharing your archetype on social platforms
• Viewing your session history on your dashboard (when signed in)

We reserve the right to modify, limit, or discontinue free features at any time.

5. Paid Services

5.1. Reports

Personalized AI Mind Analysis reports are available for purchase. Reports include archetype deep-dive, psychological deep-dive explaining why this pattern shows up in you, 5–8 personalised behavioral rules, 3 process adjustments, and a 30-day week-by-week action plan — tailored to your session results and background. Reports describe emotional patterns and discipline practices; they do not provide trading strategies, entry/exit signals, or instrument-specific recommendations.

5.2. Pricing

Prices are displayed at checkout and include applicable taxes. All prices are in the currency shown at the time of purchase. We reserve the right to change pricing at any time; changes will not affect previously completed purchases.

5.3. Payment Processing

Payments are processed by our third-party payment processor, which acts as the merchant of record. The payment processor handles all payment processing, tax collection, invoicing, and receipts.

5.4. Delivery

Purchased reports are delivered in-app on your dashboard and by email to the address associated with your account. Reports are typically delivered within 10 minutes of purchase. If you do not receive your report, contact us at [email protected].

5.5. Refund Policy

Due to the digital and personalized nature of our reports (generated specifically for your session results), all sales are generally final. However, we evaluate refund requests on a case-by-case basis. You may request a refund within 14 days of purchase by contacting [email protected]. Refunds may be granted if:

• The report was not delivered due to a technical error
• The report content is substantially incomplete or corrupted
• A duplicate charge occurred

6. AI-Generated Content

6.1. Nature of Content

Reports and recommendations are generated using artificial intelligence. AI-generated content is provided for informational and educational purposes only.

6.2. Not Financial or Trading Advice

Our reports do not constitute financial advice, investment advice, trading advice, or any other form of professional guidance. Trading financial instruments involves substantial risk of loss. Past performance is not indicative of future results. You should consult qualified financial professionals before making any investment or trading decisions. Nothing in the Product is an offer to buy or sell any security or financial instrument.

6.3. Accuracy

While we strive for high-quality, relevant recommendations, we do not guarantee the accuracy, completeness, or suitability of AI-generated content. Behavioral practices and rules that appear sound may not be appropriate for your specific circumstances.

7. Simulation Disclaimer

BrainTicker's trading simulations are educational tools. No real money is placed at risk in the simulation, and simulated P&L does not reflect actual trading outcomes. Results in a simulated environment do not guarantee similar results in live markets.

8. Intellectual Property

8.1. Our Property

The Product, including its design, code, simulation scenarios, scoring methodology, archetype definitions, algorithms, branding, and all associated intellectual property, is owned by BrainTicker and protected by applicable intellectual property laws.

8.2. Your Content

You retain ownership of the information you provide (background details, session decisions). By using the Product, you grant us a license to process this data as described in our Privacy Policy.

8.3. Reports

Purchased reports are licensed for your personal use. You may share excerpts or your archetype publicly, but you may not resell, redistribute, or commercially exploit the full report content.

9. Acceptable Use

You agree not to:

• Use the Product for any unlawful purpose
• Attempt to access accounts, data, or systems belonging to others
• Interfere with, disrupt, or overload the Product
• Scrape, copy, or reproduce the simulation scenarios, scoring methodology, or content
• Create multiple accounts to circumvent payment requirements
• Use automated tools (bots, scripts) to interact with the Product
• Reverse engineer, decompile, or attempt to extract the source code
• Impersonate any person or entity
• Submit false, misleading, or malicious data

10. Limitation of Liability

To the maximum extent permitted by law:

• The Product is provided "as is" and "as available" without warranties of any kind, express or implied
• We disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total aggregate liability shall not exceed the amount you paid to us in the 12 months preceding the claim
• We are not liable for any trading losses, lost profits, or other financial harm resulting from actions you take based on AI-generated recommendations, simulation outcomes, or any content on the Product

11. Indemnification

You agree to indemnify and hold harmless BrainTicker and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Product, violation of these Terms, or infringement of any third-party rights.

12. Termination

12.1. By You

You may stop using the Product at any time. You may request account deletion by contacting [email protected].

12.2. By Us

We may suspend or terminate your access to the Product at any time, with or without notice, for conduct that violates these Terms, is harmful to the Product, other users, or third parties, or for any other reason at our sole discretion.

12.3. Effect of Termination

Upon termination, your right to use the Product ceases immediately. Sections regarding intellectual property, limitation of liability, indemnification, and dispute resolution survive termination.

13. Dispute Resolution

Any disputes arising from these Terms or the Product shall first be attempted to be resolved through informal negotiation by contacting [email protected]. If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with applicable laws.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which BrainTicker operates, without regard to conflict of law principles.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and BrainTicker regarding the Product and supersede all prior agreements.

17. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or a notice on the Product. Continued use of the Product after changes become effective constitutes acceptance of the updated Terms.
